What Are Your FMLA Rights?
To be eligible for FMLA leave, you must have worked for your employer for at least 12 months, have logged at least 1,250 hours of work time and your employer must have 50 or more employees.
Protections under FMLA include:
- Retaining the same benefits on leave you enjoyed while actively working
- The right to return to the same job after your leave has ended or be placed in a similar job with the same benefits and comparable pay
- Employers are barred from discriminating or attempting to retaliate against you for taking FMLA leave
- Employers cannot seek to impede or deny the rights you are guaranteed under FMLA
How Do You Know if You Have a Case?
Employers who discriminate against employees protected by FMLA are often careful to disguise their true intentions. For example, an employer may choose to make a job next to impossible for an employee who has announced a pregnancy, thereby forcing the employee to quit before the employer has to provide FMLA leave. In other situations, an employer may create a reason to terminate an employee who has requested leave.
