An Experienced
Employment Lawyer

I have focused my practice on Alabama
employment law for more than 25 years.

Whistleblowers Protection/ Retaliation

A “whistleblower” is an employee who reports to an outside agency that an employer has broken the law. Under the federal False Claims Act, whistleblowers are protected against retaliation for reporting misconduct.

Oftentimes, these deceitful practices involve withholding money from the government through falsified Medicare or Medicaid claims. If a business’ employee has witnessed his or her employer intentionally violating income obligations, insurance regulations or tax obligations, that person may make a report under the protection of the government.

At the law office of Adam M. Porter, in Birmingham, Alabama, I have represented business employees, hospital billing department workers and defense contractors in reporting their employer’s fraudulent actions under the False Claims Act (also known as a qui tam action). I have protected the rights of these workers for more than 30 years.

Alabama Retaliation Attorney

The False Claims Act protects whistleblowers, who have filed a report against their employer, from retaliation tactics including termination, demotion or discrimination. It also permits whistleblowers to collect a percentage of any monies recovered as a result of the claim.

An employer’s actions are considered to be retaliation if their employee’s lawful reporting was a contributing factor in the decision to take “unfavorable” action, which can include:

  • Discharging the employee
  • Placing the employee on a blacklist (“do not hire” list)
  • Demotion
  • Pay reductions or reductions in hours
  • Withholding of wages, overtime pay or promotions
  • Denying benefits
  • Not hiring or rehiring the person
  • Intimidating, harassing or otherwise mistreating the employee
  • Reassignment to an unsuitable post or position

In whistleblower cases, privacy and discretion are of great importance. I know how to help you smoothly navigate the process. You do not need to feel intimidated or fearful if you have a case to report. You have rights and options. I will be by your side from your free initial consultation until the resolution of your claim.
